1. General

1.1 This agreement is between the hirer (named above) and Tamar Storage & Hire, The Boat Yard, Forge Lane, Saltash PL12 6LX ("the Company"). By signing this agreement you confirm you have read, understood and agree to these terms.

1.2 Where the hirer is acting in the course of a business or trade, this agreement is also subject to the CPA Model Conditions for the Hiring of Plant 2021 and the CPA Tool and Equipment Hire Supplementary Conditions 2021 ("the CPA Conditions"). Where there is any conflict between these terms and the CPA Conditions, these terms shall take precedence. The CPA Conditions do not apply to consumer hirers (individuals hiring for personal use).

2. Trailer hire

2.1 The hirer must hold a valid UK driving licence appropriate for towing the hired trailer. The hirer confirms their towing vehicle is roadworthy and legally insured for towing.

2.2 A refundable damage deposit of Β£250 is required and must be paid before the trailer is released. The deposit will be returned upon return of the trailer in the same condition as collected, subject to clauses 2.3–2.6 below.

2.3 The trailer must be returned by the agreed return date and time. Late returns will be charged at the daily hire rate per additional day or part day commenced.

2.4 The hirer is responsible for the safe keeping of the trailer from collection until return. Any damage, loss, or theft must be reported to the Company immediately by phone and confirmed in writing within 24 hours.

2.5 Damage charges: If the trailer is damaged and economically repairable, the hirer will be charged the cost of repairs. If the trailer is damaged beyond economic repair or stolen and is two years old or less, the hirer will be charged the brand new replacement value. If it is over two years old, the hirer will be charged the current replacement value.

2.6 Cleaning: The trailer must be returned in a clean condition. The hirer shall be liable for any cleaning costs incurred by the Company if the trailer is returned in an unacceptably dirty or contaminated state.

2.7 The trailer must not be sub-hired, loaned, or used by any person other than the hirer without prior written consent from the Company.

2.8 The trailer must not be modified, repaired, or altered without the Company's prior written permission.

2.9 The trailer must be used only on public roads and private land with appropriate permission. Off-road or agricultural use is not permitted without prior written agreement.

3. Storage (boat & trailer)

3.1 Storage is provided on a rolling monthly basis. Either party may terminate with 14 days' written notice. No deposit is required for storage agreements.

3.2 The Company provides a secure, CCTV-monitored yard but does not accept liability for theft, damage, or loss of stored items howsoever caused. The hirer is responsible for ensuring their own insurance covers the stored vehicle or vessel during the storage period.

3.3 The Company reserves the right to refuse storage or to terminate an agreement if a stored item is deemed to pose a safety, environmental, or access risk.

3.4 Stored items must remain within the allocated space. The hirer must not carry out mechanical or bodywork repairs on the premises without prior written consent.

4. Crate hire

4.1 Crates remain the property of the Company at all times. A minimum hire of 10 crates for 1 week applies.

4.2 A refundable deposit of Β£10 per crate is required and must be paid before delivery. The deposit will be returned upon collection of all crates in a clean and undamaged condition.

4.3 The hirer is responsible for the safe keeping of all crates from delivery until collection. Damage charges: If a crate is damaged and economically repairable, the hirer will be charged the repair cost. If a crate is damaged beyond economic repair or lost, the hirer will be charged Β£25 per crate (or current replacement value if higher), with any deposit applied against this amount.

4.4 Cleaning: Crates must be returned in a clean condition. The hirer shall be liable for any cleaning costs if crates are returned in an unacceptably dirty state.

4.5 Crates must not be used to store hazardous, flammable, illegal, or perishable items.

4.6 If crates are not available for collection on the agreed date, a late return charge of Β£3 per crate per day will apply.

4.7 The Company will agree a delivery and collection window with the hirer. Someone must be available to receive delivery and to release crates for collection.

5. Payment

5.1 Payment of hire charges and any applicable deposit is due prior to or at the start of the hire period unless otherwise agreed in writing. The Company accepts bank transfer, cash, and card.

5.2 The Company reserves the right to withhold equipment or yard access until all charges and deposits have been received in full.

5.3 Any invoice query must be raised in writing within 14 calendar days of receipt of the invoice.

6. Insurance

6.1 The hirer is responsible for ensuring they hold appropriate insurance covering their liability for loss of or damage to hired items during the hire period. The Company may require evidence of insurance cover on request.

7. Liability

7.1 The Company's liability to the hirer shall not exceed the total hire charges paid in the relevant hire period.

7.2 The Company is not liable for any indirect, consequential, or special loss arising from the hire arrangement.

7.3 Nothing in these terms limits the Company's liability for death or personal injury caused by its negligence, or for any other liability that cannot be excluded by law.

8. Termination

8.1 For open-ended hire agreements, either party may terminate by giving 7 working days' written notice. The hirer's responsibility for hired items continues until they are returned to and accepted by the Company.

8.2 The Company may terminate immediately if the hirer breaches these terms or if payment is overdue and not remedied within 10 working days of written notice.

9. Governing law

This agreement is governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
